Title:  Regulatory Panel:  HIPAA, GLB and FACTA Impact on Banking Services

Session Focus/Summary:

In the dawning of a new generation of "medical banking" services that offer cross-benefits to healthcare providers, health plans, banks and many others, regulators still appear to be isolating medical records privacy, security and transaction issues.  Banking associations have conceded that banks will likely become business associates when they have access to Protected Health Information (PHI) from a covered entity, but are banks covered entities themselves sometimes?  Some of the largest banks have opted for "hybrid covered entity" classification under HIPAA, as clearinghouses, to calm their healthcare customers.  Yet although organizations like the Medical Banking Project and NCVHS specifically asked CMS to clarify issues around this classification, they have received no comments.  This session will look at the regulatory landscape caused by HIPAA.  We will provide an overview of the HIPAA Security Rule that compares new requirements with existing banking regulatory requirements. We will also touch on policy aspects of Title V of the Gramm-Leach-Bliley Act (Reg. P) and FACTA.

Learning Objectives:


  1. Participants will have a greater understanding of the policy issues, and potential market impact, related to HIPAA's application to banks and financial services.
  1. Participants will isolate potential gaps between the requirements of the HIPAA Security Rule and other bank regulations.
  1. Participants will have a better understanding of the policy impacts on banking and financial services of GLB/Reg. P and FACTA.
  1. From a regulatory standpoint, we'll peer into the future of a consumer-directed healthcare environment and related privacy and security issues.
